General Terms and Conditions (GTC) for Kazaar Fragrances
Scope of Application
The following General Terms and Conditions (GTC) apply to all contracts between the online shop (hereinafter referred to as the "Seller") and the customers (hereinafter referred to as the "Customer") concluded via the Seller's website. Contrary or deviating conditions of the Customer are not acknowledged unless the Seller has explicitly agreed to their validity in writing.
Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding online catalog. By clicking the "Buy" or "Submit Order" button, the customer places a binding order for the goods contained in the shopping cart. The confirmation of the order follows immediately after the order is submitted and does not yet constitute acceptance of the contract. The contract is concluded when the Seller confirms the acceptance of the order through an order confirmation via email or by delivering the goods.
(2) The Seller is entitled to reject the acceptance of orders without providing reasons.
Prices and Payment Terms
(1) All prices are given in Euro (EUR) and include the applicable value-added tax.
(2) The customer has the option to pay by credit card or PayPal. The seller reserves the right to exclude specific payment methods in individual cases.
Delivery and Shipping Costs
(1) Delivery is available within Switzerland, Liechtenstein, Germany, Austria, and neighboring EU countries.
(2) The delivery time is typically 2-5 working days from the order confirmation, unless expressly stated otherwise in the item description.
(3) The seller shall not be liable for delivery delays arising from force majeure, natural disasters, or other events beyond the seller's control.
(4) The customer is to pay shipping costs which will be displayed during the ordering process.
(5) Shipping costs will be covered by Kazaar for orders with a value of 100 CHF or more.
Right of Withdrawal and Returns
Due to our hygiene regulations, we cannot accept returns of opened or used fragrances. Contaminated, used, opened, or damaged items will not be accepted for return and will be sent back to the sender. The cost of return shipping and handling, as well as the risk of loss or damage to our returns department are the responsibility of the buyer in any case.
Any additional costs resulting from a customer providing an incorrect address, even if it's due to minor details like missing or incorrect additional address information, will not be reimbursed or covered by Kazaar, irrespective of the situation or circumstances.
Cancellations cannot be guaranteed as Kazaar operates with an automated logistics system. Once your package has been shipped, it cannot be canceled.
Kazaar reserves the right to request evidence in case of damage to verify the condition of the affected goods. If such evidence cannot be provided, we will not be liable for the damage.
Orders that include a discount are non-returnable. The Swiss right of withdrawal applies to the entire online shop. By making a purchase, you agree to all terms and conditions.
Warranty and Liability
(1) The warranty is governed by the legal provisions of the Swiss Code of Obligations.
(2) The Seller shall not be liable for any damage not suffered by the object of delivery, especially not for lost profits or other financial losses incurred by the customer.
Data Protection
(1) The customer's data necessary for transaction processing will be stored and processed in accordance with data protection laws.
(2) The customer has the right to information, correction, deletion, or blocking of their stored data at any time.
(3) The complete privacy policy can be viewed on the seller's website.
Discovery Kit Provisions
The Discovery Kit is a product offered by Kazaar at no cost. It includes 5 samples of selected fragrances.
The customer is obligated to cover the shipping costs to receive the Discovery Kit.
Each customer is allowed to order and receive only one (1) Discovery Kit.
In the event of ordering more than one (1) Discovery Kit, only one (1) kit will be delivered, regardless of the quantity ordered.
Kazaar reserves the right to change or update these provisions at its discretion. All changes will be published on the Kazaar Fragrances website and will be effective from the date of publication.
The Discovery Kit is subject to Kazaar's general terms and conditions.
Kazaar reserves the right to terminate or modify this offer at any time.
The offer is valid from October 19, 2023, to October 30, 2023.
General Terms and Conditions (GTC) for the Black Friday and Black Week Lottery:
Duration of the Promotion: The promotion starts on 20.11. at 00:01 (12:01 AM) and ends on 26.11. at 23:59 (11:59 PM).
Participation Conditions: During the promotional period, each customer will receive one entry for the lottery for every euro spent. Discounts will not be taken into account for the allocation of entries. For example: Original price 100 euros - 20% discount = 80 euros = 80 entries.
Lottery Items: The lottery includes the following items:

3.2 Cartier Santos, Vintage 2023
3.3 100 Grams of Swiss Gold (Raiffeisen)
3.4 Rimowa Suitcase Check-In L Classic (Color: Silver)

Conducting the Lottery: The lottery will take place in mid-December.
Legal Provisions: The promotion and lottery are conducted in accordance with the applicable laws and regulations of Switzerland. The promotion is not affiliated with Facebook, Instagram, or any other social media platforms.
Changes and Termination of the Promotion: The company reserves the right to change the terms and conditions of the promotion at any time. In case of fraud attempts, technical issues, or other unforeseen circumstances, the promotion may be terminated or suspended.
Disclaimer: The company is not liable for technical issues, losses, or delays related to participation in the promotion or lottery.
Data Protection: Data collected during the promotion will be handled in accordance with privacy regulations. Information regarding this is available on the company's website.
Claiming Prizes - Rolex, Cartier, and Gold: Winners of the Rolex Datejust Grey Dial, Cartier Santos, and 100 Grams of Swiss Gold are required to personally collect their prizes at our Headquarter Office in Switzerland. Shipment of these prizes is not possible.
Shipping of Rimowa Suitcases: The Rimowa Suitcases (Check-In L Classic and Cabin Classic) will be shipped from Switzerland to the winners. Standard shipping conditions apply.
Free Participation: Participants have the option to participate in the lottery for free. For this, a written request can be sent to Kazaar LLC, 254 Chapman Rd, Ste 208 #15427 Newark, Delaware 19702 US. Details regarding free participation will be provided to the participant after the request is reviewed.
By participating in the promotion, the customer agrees to these terms and conditions.
Black Week Special Regulation: Return Policy:
Orders placed during the Black Week from 20.11.2023 to 23.11.2023 are subject to a special regulation regarding the return policy. In accordance with this provision, products purchased during this period cannot be returned or exchanged unless they have defects or damages.
Legal Provisions: This special regulation does not affect the customer's statutory rights as per applicable consumer protection regulations.
This Black Week Special Regulation applies exclusively to orders placed during the mentioned period and does not impact the regular return policy outside of this timeframe.
Final Provisions
(1) Swiss law applies to contracts between the seller and customers. The application of the UN and/or EU sales law is expressly excluded.
(2) If the customer is a merchant, legal entity under public law, or a public-law special fund, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the seller is the seller's registered office.
(3) Should individual provisions of these terms and conditions be or become invalid in whole or in part, the validity of the remaining provisions shall not be affected thereby.
